1. Acceptance of Terms

2. No Contract Formation

Use of this website does not create a contract.

A binding agreement exists only when a written service agreement is signed by both Apex Tree LLC and the customer.

Estimates, emails, text messages, or verbal statements do not constitute a binding service contract.

3. Estimates & Pricing Disclaimer

All estimates:

• Are based on visible conditions at time of inspection

• May change due to hidden decay, underground utilities, unstable soil, weather conditions, structural weakness, access limitations, or concealed hazards

• Are subject to change until a written contract is executed

• May include emergency pricing adjustments during storm response

Apex Tree LLC reserves the right to modify or withdraw any estimate prior to contract execution.

4. Acknowledgment of Inherent Risk

Tree removal, trimming, storm response, and related services involve significant inherent risks, including but not limited to:

• Falling limbs or debris

• Property vibration damage

• Equipment malfunction

• Ground disturbance

• Unforeseen structural failure

By requesting services, the customer acknowledges and accepts these risks.

5. Limitation of Liability

To the fullest extent permitted under Kentucky law:

• Apex Tree LLC shall not be liable for indirect, incidental, special, punitive, or consequential damages.

• Liability shall not exceed the amount paid for the specific service giving rise to the claim.

• Apex Tree LLC is not responsible for damage caused by pre-existing defects, hidden decay, prior improper construction, or acts of nature.

6. Indemnification

Customer agrees to defend, indemnify, and hold harmless Apex Tree LLC, its owners, employees, subcontractors, and affiliates from any claims, damages, losses, liabilities, or expenses (including attorney fees) arising out of:

• Customer’s failure to disclose known hazards

• Inaccurate property boundary information

• Misuse of website content

• Violation of these Terms

7. Force Majeure

Apex Tree LLC shall not be liable for delays or failure to perform caused by events beyond reasonable control, including:

• Severe weather

• Natural disasters

• Equipment breakdown

• Supply shortages

• Government action

• Acts of God

8. Arbitration & Dispute Resolution

Any dispute arising from website use or services shall be resolved exclusively by binding arbitration in the Commonwealth of Kentucky.

• Arbitration shall occur in the county where Apex Tree LLC’s principal office is located.

• Customer waives the right to jury trial.

• No class actions permitted.

• Kentucky law shall govern the proceedings.

9. Attorney Fees

If Apex Tree LLC prevails in any dispute, it shall be entitled to recover reasonable attorney’s fees and costs.

10. Service Territory

Apex Tree LLC reserves the right to decline services outside its designated service area.

Additional travel fees may apply.

11. Intellectual Property

All logos, branding, truck graphics, photographs, videos, and written content are the exclusive property of Apex Tree LLC.

Unauthorized use may result in legal action under applicable intellectual property laws.

12. Third-Party Links

Apex Tree LLC is not responsible for third-party website content linked from this site.

13. Modifications

These Terms may be updated at any time without notice. Continued website use constitutes acceptance of revised Terms.
